I had a case in 2007; I had no criminal record and was given a felony for forgery PC 470d. Since this case was a wobbler, which is a case that could be a misdemeanor or a felony (determined by the district attorney) would not hurt my chances of getting into the military. They gave me a felony and I have not been able to get into the military or any decent job. My attorney, Martin King, did not fight for me and gave me false information. Multiple years in school and a master degree later and I can't even use it; I cannot get a job because the original sentence (felony) that was later reduced and then expunged does not matter to any city, county, state, or federal government employers. The original sentence of the felony is all that matters. He told me it would not affect me but he was totally wrong. How can a practicing criminal attorney and law professor not know this? Which leads me to conclude, he did not care or he is a liar. I have talked to other attorneys since this happened and was told this case was handled very badly. I should not have received a felony; it was totally up to the prosecutor, Johnny GoGo (real name). My attorney should have not allowed this to happen, my family and I knew something was off but we trusted in what he was saying. None of us had any experience in dealing with any type of litigation. GoGo and King acted like country club buddies during multiple court hearings. I guess my case was not important enough for him to fight for me, save it for the murderers. Win win situation for GoGo, felony charge for his stats and King, wink and nod for the next more important case. I scratch your back now; you scratch my back later. King left me hanging, and both knew my background, me having no criminal record, college degree, fully employed for years should have dictated a misdemeanor and not a felony. The circumstances at best showed I was a patsy because I showed my driver license to the clerk and hand writing expert said I did not forge the check; additionally the people who I received the stolen check from had done this in the past to other people. King and the D.A. had their records I gave them their names and addresses. I just wish I would have talked to other attorneys before this happened, hindsight is better than foresight but maybe I can help someone else in this type of situation. Seven years later, graduate school, etc. I cannot progress in life for less than 2,000.00 dollars that never touched my hands. Military, county, city, state will not hire me. If I would have been sentenced correctly, the misdemeanor would have allowed me to join the military as an officer. I cannot even get a job in a group home, selling insurance, anything that requires a license or security clearance is out of my reach.
