Mediation Mediation is a fast, inexpensive, and private process for resolving disputes through the intervention of someone outside the problem. Mediation is confidential, and voluntary. It is binding only when the parties reach a settlement. The mediator serves as both a facilitator and the devils advocate. A mediator challenges the disputants assumptions in private meetings. Only that information the parties wish to share is presented to the opposing party. Mediation improves communication and defuses anger. The process generates settlement options, translates wants into needs, and allows the parties to consider their alternatives to a settlement. It serves as a reality check for each partys opinion about their strengths and weaknesses in the dispute. Brice Buehler was the first attorney in Arizona with a full-time alternative dispute resolution practice and has pioneered ADR in Arizona, Nevada, and New Mexico. He has conducted more than 2500 mediations and arbitrations.
