"800TrialMD Philadelphia, Pennsylvania is a Great Law Firm. Mr. Spencer found what others did not. He greatly helped my son and our entire family. My son Brian was born with a birth defect commonly known as Spina Bifida. He had a whole hole in the bottom of his spinal column, near his tail bone, from which cerebral/spinal fluid was leaking. We were told it was because his spinal column failed to completely develop. Doctors explained that Brian would likely need two surgeries: first to close the hole and stop the leak, and second to treat the likely development of hydrocephalus because Brian’s body was used to making more cerebral/spinal fluid than would be needed after the leak was stopped. The first surgery went well, the second did not. Brian was severely brain damaged during the second surgery. The doctors at the hospital would only say that with Spina Bifida sometimes poor brain function also happens. Mr. Spencer took over our case. He found that during the second surgery, Brian’s breathing tube had fallen out. The anesthesiologist who should have immediately reinserted it did not notice until it was too late. Brian’s brain had been massively damaged because of a lack of oxygen. When we got to trial, the defense attorneys and the defense experts all testified that Brian’s brain problems were part of the birth defect of Spina Bifida and not the surgery. But, Mr. Spencer found nurse’s notes in the record that showed that before this second surgery, Brian had been a typical Newborn kicking his legs and freely moving his arms. Following the second surgery, the notes all stated that Brian was “flaccid,” a medical term that meant he just laid there and did not move. Mr. Spencer also cross-examined the defense on the findings on CT scans which showed brain damage consistent with lack of oxygen. Mr. Spencer was able to convince the jury to award $10 Million dollars. As a result, we were able to pay for very expensive therapies, equipment, medical care and other types of care. These all greatly improved Brian’s life."
