Frank Benavidez was paid too much for a job. He received a mid job payment of $200 for materials and $800 for work to be performed. The original quote was for a $1400 job plus materials. When the job was completed, there was a dispute on billing. The consumer wrote Frank a check for the entire amount not taking into account the mid job payment (in error). Frank is aware of the overpayment and was contacted on 11/14 about him cashing the check that was too much. On 11/19, Frank was told that the BBB would be contacted if he did not refund the overpayment. He noted he was out of town and would return 12/1 The consumer waited patiently. I contacted Frank on 12/1 and 12/2. On 12/2, Frank noted he will pay me on 12/6. He NEVER contacted me but was contacted numerous times. On,12/9 the BBB was contacted. Given Frank has been both overpaid and had ample time to return the funds, and hasn’t done so….I have no recourse but to let people know that Frank did this.. I regret not withholding funds on the draft. I will update this dispute once Frank refunds me-if he ever does..... It is now January 6, 2014 and to this point, no contact from Frank. Please note, the address the business uses does not exist. He does not answer calls from those he has an issue with. Good luck in getting ahold of Frank if you have problems....1/10/14 update - BBB noted he didn't respond to thier calls. ....Nice guy in person, but at this point very UNFAIR with me....
