In Jan 2013, my attorney Sanford Dow of DGRB recommended Alan F. Levin of The Levin Law Group PC to serve as mediator and arbitrator in a civil case. Already unethical to do both. Unbeknownst to me, I was unaware that Mr. Levin had been previously sued for professional malpractice by The Kassab Law Firm. Had I known I would have never agreed to hire him to serve as mediator/arbitrator. Mr. Levin included legal language in the settlement agreement that I signed that said if a party 'refused' a second mediation that they waived their rights to attorneys fees. When Strasburger & Price refused a second mediation, Mr. Levin said on a recorded line that he should have never put that legal language in the contract and so he would ignore it and awarded Strasburger >$300K of attorneys fees anyway. When does a law license give an attorney the right and/or authority to ignore their own legal language of their own contract that they drafted ? Unconscionable and egregious.
