I went to court on April 17 and the judge ruled that I had to serve 3 days in jail for a DUI.



Problems: was in jail at SCORE (July 28 to Nov 24 2012, and then was in custody of Snohomish county and being transferred thru King County). While being held at King County, I was moved to Harborview ER, and admitted to hospital for surgery on Nov 26, I was in custody of Snohomish County at this time. My surgery was at 12:30 AM Nov 26. Snohomish county release the hold because of the surgery, the hold was removed when I was admitted to the Hospital 11/26. I should have been credited with the time served from Nov 24 to Nov 26. At the time of sentencing, I brought information to attention of Judge, Prosecutor, and my attorney, Emily Haskin (Public Defender). It was determined that the

Time Served was "To Be Determined". I spoke to the clerk, and while speaking to the clerk, my attorney said that she would research, and let me know how many days I would be responsible, (if any), to serve. I spent the last week (May 6 to May 10) leaving messages at PD office, no response to my messages. On May 13, I called her at 1:30 AND left her another message. At 2:30 PM, she returned my call, and said I had 5 hours to turn myself in at Snohomish County Jail, in Everett. She had no new information regarding the amount of time I was required to serve, only information she had was that I had to do three days and she claimed to have sent me a letter, but she did not have a correct address, but she had received by phone messages, and has my phone number, email address, and could have called, but she indicated that it was not her responsibility now that the case had been settled.



In calling the Probation office, Court Clerk, and all other avenues to see if anything had been resolved, all answered were "to contact my lawyer". However, multiple attempts to contact her, were ignored. I go to school, and have limited ability to obtain this information, and depended on her to assist me, and I feel that she let me down. I have called King County Jail to see if they would give me the amount of time served, but they told me that my attorney would have to request that information.



I am now facing more jail time, warrant, and jeopardizing my school, and grant because my PD did not follow up with this. I was prepared to turn myself in, if that was necessary, but being given 5 hours of notice, when I live in South King County, and depend on the bus service, I could not get there. Additionally, my court date in April was April 17th, and I thought I had 30 days to report to jail.



I am writing this to let other people know not to trust your Public Defender, I felt that I was improperly represented by my attorney, and she was in a hurry to get me processed thru the system, and then remove me from her roster. Do everthing you can, on your own to protect your rights and make sure your case is heard fully. I will be pursuing this thru the Bar Association and writing a letter of complaint as they recommend.
