The worst experience I ever had as a tenant!! The owner is very rude!! There was no management team in the office for 4 months. Within that time frame, my apartment was broken into and the owner never complied with the police to turn over the surveillance camera video. Come to find out the cameras are dummy cameras where they either don't work or don't record. In the latter, a security guard was suppose to be monitoring the cameras in case of a criminal act on the premises which the low-life owner wouldn't provide. When I questioned the owner about the camera surveillance 1 1/2 months after the robbery he got upset and had me evicted. He violated the due process procedures of the law under O.C.G.A. 44-7-50 as James T. Walker III was first supposed to have provided me with a DEMAND FOR POSSESSION letter and given me time to move out before filing with the court in order to have the legal ground to go file for an eviction.Henderson v. Colony West, Ltd., 175 Ga.App. 676, 332 S.E.2d 331(1985) "Demand for possession is proper only if at time of demand the lease is terminated.";Broadwell v. Maxwell, 30 Ga.App. 738(1), 119 S.E. 344; Bussell v. Swift, 50 Ga.App. 148, 177 S.E. 277, a demand upon the tenant to deliver possession to the landlord is a condition precedent to the right of the landlord to dispossess.";Metro Management Co. v. Parker 247 Ga. 625, 278 S.E.2d 643(1981) "In every case, timely demand for possession is condition precedent to institution of dispossessory proceedings pursuant to statute enumerating grounds under which landlord may elect to dispossess tenant."; Terrell v. Griffith, 129 Ga. App. 675, 200 S.E.2d 485(1973) "Prerequisite to the right to seek dispossessory warrant is a demand for possession of the property by the landlord. Code s 61-301.; Owens v. BarclaysAmerican/Mortgage Corp., 218 Ga.App. 160, 460 S.E.2d 835(1995) "Under OCGA ยง 44-7-50 (which was revised effective July 1, 1995), an owner taking possession of the premises from his **838 tenant is required to follow certain procedures. Specifically, the owner must "by himself, his agent, his attorney in fact, or his attorney at law, demand the possession of the property...." If, after demand, the tenant refuses to deliver possession and the owner still desires to dispossess him, the owner must by himself, "his agent, his attorney at law, or his attorney in fact ..." make and file an affidavit for possession. OCGA 44-7-50. If the owner "forcibly [dispossesses] a tenant" without following these procedures, the owner is subject to an action[lawsuit] for trespass." He additionally filed a false claim for rent by not prorating the rent on a daily basis as contracted. Under the law filing a false claim is a misdemeanor(O.C.G.A. 44-7-58). After making a deal to stop the eviction and paid my rent, the property manager then told me not to come to court as she stopped the process. She then 5 days later went to court and obtained a default judgment. I had that judgment vacated and Mr. James T. Walker III filed another illegal claim, which the court refused to vacate after countless petitions. After my belongings were put out on the street, I went to get a truck to move them from the property. Mr. James T. Walker III had an associate come to the complex who called me by my name and told the residents that he was my uncle, then stole everything I owned. Mr. James T. Walker III's maintenance guy helped this individual load all of my possessions on the truck. A detective has been trying to get in contact with Mr. Walker concerning this incident but as of the last time I spoke with the detective he hadn't returned his calls. In closing, I rated this a one because I had to in order to publish this statement. I stand behind every word.
